BMC, Tata Power blamed for Jogeshwari-Vikhroli Link Road pothole that killed 16-year-old pillion rider

MUMBAI: The Aarey Colony police will file a chargesheet in the Borivli magistrate's court this week in connection with a six-month-old negligence case where a pothole on Jogeshwari-Vikhroli Link Road claimed a 16-year-old student's life. The police have booked one employee each of the BMC and Tata Power Company (TPC) under sections 304 (A) (causing death of a person by any rash or negligent act not amounting to culpable homicide) and 338 (grievous hurt) of the Indian Penal Code.
On July 28, 2015, Prakash Bilhore, was riding pillion with his cousin Ram after completing admission formalities at a Bhandup college when the bike hit a water-filled pothole near MIDC-Seepz Gate No 3. Ram escaped with injuries, but Prakash died en route to the hospital.
"The FIR, registered five days after the mishap, stated that 'unknown people' were responsible for the mishap. It took the police six months to establish who the accused were," said Dadaram Bilhore, Prakash's father.
"TPC conducts repair and maintenance work of its underground cables after taking BMC's permission. The firm has to give BMC a daily status report of its work and also inform when the work is over. The BMC then fills up the pits dug for the cable work. But we did not find appropriate written communication between the two agencies in the JVLR case," said senior inspector Vilas Chavan.
Dadaram, who sells vegetables for a living, told TOI that he wants justice not just for Prakash, but for every family that has lost a child to potholes. "I will pursue this case till the end. I will go to court independently against the BMC and Tata Power, if there is no police action," said the Andheri resident. Both TPC and BMC officials were unavailable for comment.
In January, a Bandra resident had sued the BMC for Rs 1.5 crore in damages for the grave injuries he sustained after falling into a partially open gutter on a pavement at Carter Road
